1. Acceptance of Terms

Welcome to SureHire, operated by SURV7X, Inc. ("SURV7X," "we," "us," or "our"). By accessing or using the SureHire platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

These Terms apply to all users of the Service, including job seekers ("Candidates"), employers and hiring managers ("Companies"), and any other visitors or users.

2. Description of Service

SureHire is an AI-powered intelligent hiring platform that examines candidates across four key areas: Culture Fit, Technical Fit, Total Person Concept, and Unique Role Requirements. The Service includes, but is not limited to:

  • AI-powered candidate assessments and interviews
  • Resume parsing and skills analysis
  • Identity and document verification
  • Hiring risk scoring and candidate reports
  • Job posting and application management
  • Candidate-employer matching and recommendations
  • Subscription-based premium features

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement.

4. User Responsibilities

4.1 Candidates

  • Provide truthful and accurate information in your profile, resume, and interview responses.
  • Complete assessments honestly and without unauthorized assistance.
  • Respect the integrity of the assessment process and not attempt to manipulate scores.
  • Maintain the confidentiality of interview questions and assessment content.

4.2 Companies

  • Post accurate and non-discriminatory job descriptions.
  • Use candidate data solely for legitimate hiring purposes.
  • Comply with all applicable employment laws and regulations, including EEOC guidelines.
  • Make final hiring decisions independently; AI-generated scores and reports are advisory tools, not determinative.
  • Maintain the confidentiality of candidate information accessed through the platform.

5. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Impersonate another person or entity, or falsely represent your affiliation.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Interfere with or disrupt the Service or servers/networks connected to the Service.
  • Use automated means (bots, scrapers) to access the Service without written permission.
  • Upload malicious code, viruses, or harmful content.
  • Discriminate against candidates based on protected characteristics.
  • Share, sell, or redistribute candidate assessment data outside the platform.

6. Subscriptions and Payments

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscriptions are billed on a recurring basis (monthly or annually) and will auto-renew unless cancelled.

  • Free Tier: Candidates may access basic features at no cost, including one active application.
  • Pro Tier: Enhanced features for candidates, including multi-job tracking and priority placement.
  • Company Plans: Tiered plans for employers with varying levels of access and features.

Payments are processed by Stripe. By providing payment information, you authorize us to charge the applicable fees. Refunds are handled in accordance with our refund policy. Contact [email protected] for billing inquiries.

7. Intellectual Property

The Service, including its design, features, content, algorithms, and branding, is owned by SURV7X and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

You retain ownership of content you submit (resumes, profiles, responses). By submitting content, you grant SURV7X a non-exclusive, worldwide license to use, process, and display such content as necessary to provide the Service.

8. AI-Generated Content and Assessments

The Service uses artificial intelligence to generate assessment scores, candidate reports, interview questions, and hiring recommendations. While we strive for accuracy and fairness:

  • AI-generated outputs are advisory and should not be the sole basis for employment decisions.
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
  • Companies are responsible for ensuring their use of AI-generated assessments complies with applicable laws.
  • Candidates may request human review of AI-generated assessments.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURV7X SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR EMPLOYMENT OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Indemnification

You agree to indemnify and hold harmless SURV7X, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Salt Lake City, Utah, in accordance with the rules of the American Arbitration Association.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
